Mental Health: Giving Tanks

For the past three years, Robyn Posson has written in her gratitude journal every day about all the good things in her life. She admits it was sometimes tough to find something to appreciate. "Some days, I would just put down that I was happy I had hot water for a shower," says the mental health counselor from Schenectady Community College .

Her journal sits close on her work desk. When she's having one of those rough days, she pulls it out to read some of her entries or to write something positive. "It does make me feel better. People don't like to talk about gratitude," Posson says. "Some think the idea of living a life of gratitude is something from way out in left field. But since I started having this mindset about gratitude, it has made such a huge difference for the better."

Posson, who also owns Trinity Cottage Weddings and officiates weddings each week, wasn't finding love herself and she wasn't making a whole lot of money in her new business. When she made gratitude a priority, things started happening in her life. Her business is booming, and she has found her soul mate.

Is this change a coincidence or is something else going on? Scientific research has just begun to reveal that positive feelings of gratitude and thankfulness can actually keep people healthier and mentally sound.

Professor Robert Emmons , a psychology professor at the University of California-Davis and editor of the Journal of Positive Psychology , says the practice of gratitude can increase happiness levels by around 25 percent. Just spending a few hours writing in a gratitude journal over three weeks can have lasting effects, he says, for as long as six months. Those who did the journal, he says, reported benefits that included longer and better quality sleep, increased regular exercise -- which can have its own health benefits -- fewer physical symptoms for existing health issues, a better attitude and more optimism about life as a whole.

  In this case, Rebecca Howell was hurt badly in a car-truck accident by a Hamilton Meats driver who wasn’t watching were he was driving; Hamilton agreed to both liability and the necessity of the medical treatment provided.  The only issue at hand was what compensation should be paid to Rebecca and whether Rebecca should receive compensation for the full amount her medical providers billed or the reduced amount actually paid to providers. The actual payments made were reduced due to a pre-existing contract between her medical providers and her medical insurance company.

In this case, injured persons lost; big insurance companies won and will benefit from the medical insurance benefits that injured persons pay for.  This decision spits in the face of the long established “collateral source rule” which provides that wrongdoers should not benefit from the fact that injured persons have purchased insurance.  In other words, Rebecca should be entitled to full compensation for the medical benefits provided and billed because she paid for her  health insurance which was a collateral source of compensation, not meant to help the wrong doer.

Instead, the court held that Rebecca will only receive a discounted amount, the difference between  the amount actually paid, by her health insurer and not the full bill.  Rebecca has paid tens of thousands of dollars for her health insurance over the years.  The wrongdoer gets the full discount, without paying one penny for any of it.

In the court’s own words, “ When a tortiously injured person receives medical care for his or her injuries, the provider of that care often accepts as full payment, pursuant to a preexisting contract with the injured person‘s health insurer, an amount less than that stated in the provider‘s bill. In that circumstance, may the injured person recover from the tortfeasor, as economic damages for past medical expenses, the undiscounted sum stated in the provider‘s bill but never paid by or on behalf of the injured person? We hold no such recovery is allowed, for the simple reason that the injured plaintiff did not suffer any economic loss in that amount. (See Civ. Code, §§ 3281 [damages are awarded to compensate for detriment suffered], 3282 [detriment is a loss or harm to person or property].
