Libya ‘issues summons’ for Al Qathafi’s ex-PM

( al Arabiya ) - Libya has issued a summons for Muammar Al Qathafi’s former Prime Minister Baghdadi al-Mahmoudi, who fled the country for neighbouring Tunisia, the interim justice minister said Wednesday.

“The prosecutor general has issued a summons for former Prime Minister Baghdadi al-Mahmudi,” the minister, Mohammed al-Alagi, told a news conference in Tripoli.

Mahmoudi, Libya’s prime minister until the last days of Al Qathafi’s regime, was arrested last week on Tunisia’s southwestern border with Algeria.

A Tunisian court swiftly sentenced him to six months in prison after finding him guilty of illegal entry, but that decision was overruled on Tuesday by a higher court following an appeal by his lawyers.

Mahmoudi’s arrest was the second in Tunisia of a senior Libyan official since the fall of the regime run by Al Qathafi, who has been on the run since Libyan rebels took the capital Tripoli on August 23.

( N. Y. Times ) - Col. Muammar Al Qathafi, the fugitive former leader toppled from power a month ago, has likely taken refuge near the Algerian border under the protection of sympathetic nomadic tribesman who have fought for him, officials of the new Libyan government said Wednesday.

The officials also said they believed Colonel Al Qathafi’s heir-apparent son, Seif al-Islam Al Qathafi, was hiding in the loyalist desert enclave of Bani Walid, and that a second son, Muatassim Al Qathafi, a militia commander and former national security adviser, was in Sirte, the Al Qathafi clan’s hometown on the Mediterranean coast.

Armed supporters of Colonel Al Qathafi in Bani Walid and Sirte have defied demands for surrender by anti-Al Qathafi forces that have besieged both towns.

In all likelihood, the House will conduct their first vote on the repeal of the patient Protection and Affordable Care Act, a.k.a. ObamaCare on Wednesday. The attempt to repeal ObamaCare comes on the heels of a newly elected 112th Congress set forth to embrace the constitutional limits of government.

Authority and constitutionalism

Much of the debate surrounding ObamaCare and its repeal stem around the question of whether or not the Obama administration possesses the constitutional right to impose a mandate to purchase health insurance products on the people. On September 9th, 2009, President Obama stated the following before Congress; “[U]nder my plan, individuals will be required to carry basic health insurance...” This came as a shock to many who stood by the President and his prior claims nationalized health care would not be implemented with a mandate. However, the lesser discussed aspect of the mandate is in “authority.”(1)

The 112th Congress started with a ceremonial reading of the U.S. Constitution, an event which was criticized as “ritualistic” and meaningless.(2) Jumping to conclusions and judging Congress’ first ever opening session with a constitutional reading forced the overlooking of what was to follow. It is the intent of the new Congress to restore constitutional limits on government. This led to a new House rule (Rule XII) requiring each new piece of legislation to clearly state its constitutional authority.
