Mystery Diagnosis: An Era of Uncertainty for the Health Care Sector
The American sector of health care is experiencing a time of change and uncertainty. Although the plan Obama's health care reform was enacted last year, several legal challenges to legislation are making their way through the courts. Questions also remain about whether the law will keep its promises of better access to care and strict containment of the soaring costs of health care.
Political policy?
After decades of debate on the reform of national health care, legal studies and health care management Wharton Professor Arnold Rosoff warned that the struggles of the Affordable Care Act (CAA), promulgated by President Obama March 2010, may be far from over. It is uncertain whether the reform legislation, which was adopted in a form severely compromised after years of "partisan bickering" may keep its promises to control costs and expanded access to health care for the insured, Rosoff noted. "But before we get there, we must ask," Is ACA even remain in the books?"
Several legal challenges threaten to reverse the historic reform. Most cases, according to Rosoff, focus on the so-called "individual mandate" requiring individuals to buy insurance for themselves and their dependents, with a secondary accent on the "employer mandate", which requires large employers to cover their workers. The ACA provides grants to those unable to pay the premiums and imposes penalties for failure to buy health insurance.
Of the six cases that have been tried on the merits in the federal district courts, three AmericansDistrict judges, all appointees of former President Bill Clinton (Democrat) have confirmed the reform of the law. The other three judges, acting on complaints filed in Virginia, Florida and Pennsylvania, decided that the law violates the U.S. Constitution. Judgeswere those three Republican presidents appointed by George W. Bush and Ronald Reagan. "This gap highlights the fact that the contest is sharply partisan and political," said Rosoff.
