New laws expand insurance coverage for oral chemo, drug trials
Hundreds of patients across Illinois will benefit from new state laws requiring health-insurance plans to cover oral chemotherapy drugs and routine medical costs associated with clinical trials of new cancer treatments, supporters of the laws say.
“We’re just trying to get to the point where the doctors and the patients can make the best medical decisions,” said David Woodmansee, an associate director of the American Cancer Society’s Cancer Action Network in Washington, D.C.
House Bills 1825 and 1191 were passed unanimously last year by the Illinois General Assembly and signed into law by Gov. Pat Quinn. Both laws took effect Jan. 1.
The Illinois Chamber of Commerce, which often opposes state insurance mandates, didn’t object to the two bills, because their mandates won’t significantly increase insurance costs for employers, according to Jay Shattuck, executive director of the chamber’s Employment Law Council.
However, the laws won’t help the 50 percent of Illinoisans who are covered by self-funded health plans through their employers. Federal law exempts self-funded plans from state health insurance mandates, and the exemption won’t be affected by the federal Affordable Care Act.

Several doctors from Springfield’s Southern Illinois University School of Medicine’s Simmons Cancer Institute testified in favor of the bills in front of legislative committees.
Medical oncologist Dr. Robert Mocharnuk, one of those testifying, told The State Journal-Register that some SIU cancer patients have had problems in the past getting their health insurance plans to cover equipment and labor costs associated with receiving intravenous medicines in clinical trials.
Clinical trials often offer patients cutting-edge treatments that can save or extend lives, and the medicine itself usually is covered by the trial, Woodmansee said. About 35 states require coverage of the associated medical costs, he said.
